| a | Photographs, pictures and other representations are only indicative of the products and not necessary of the actual product supplied. They are often supplied to us by the manufacturer or distributor of the product and are subject to change. | |
| b | You should take reasonable steps to ensure that the product is suitable for the purpose intended. | |
| c | All products are subject to availability. If we are unable to supply a particular product, we may offer you an alternative, which you will be entitled to reject. | |
| d | Prices of products are shown exclusive of delivery charges. | |
| 3 | Formation of contract and order acceptance | |
| a | We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide on your Order Form. Our acceptance of your order brings into existence a legally binding contract between us. | |
| 4 | Incorrect Information Provided by The Customer | |
| a | We are not responsible for any additional costs or inconvenience incurred due to incorrect information provided by the customer. This can include (but is not limited to) incorrectly typed address or post code. | |
| 5 | Cancellation and Returns for consumers | |
| a | You may cancel your order at any time before or up to seven working days (Monday to Friday inclusive) after the day of shipment of your item, without penalty and without the need to give a reason (this applies to individual consumers and not business purchasers). | |
| b | Please note: | |
| i | A product must be returned in an unused condition in its original, undamaged packaging, with all seals in tact, together with the product receipt. | |
| ii | Products are returned at your expense unless the product is faulty when you receive it. | |
| iii | You are wholly responsible for the cost of delivery and safe return of the goods. Good received back incomplete or in a damaged or used condition will be returned to you and the cost of redelivery charged to your account. | |
| iv | Your right to cancel will not apply if the products are made or tailored to your specification or personalised at your request. | |
| v | Where agreed in advance, we may accept products back that have been used/opened however, these goods will be subject to a restocking fee of not less than 20% of the original purchase price (final figure is dependant upon the condition of the goods and their packaging) | |
| c | On receipt of your notification of cancellation, the price of the products will be credited to your credit/debit card within 30 days, beginning with the day on which notice of cancellation is given. Should you fail to return the products to us within 30 days of your notice of cancellation, you will be deemed to have accepted the products. We are not responsible for non-delivery of returned goods and it is recommended that you obtain proof of posting and/or delivery insurance as appropriate. | |
| d | To cancel your order or return an item, in the first instance please contact us by email. Quote your Invoice Number or Order Number, the item(s) being returned, your name and address. We aim to reply to your email within one working day, informing you the correct address for the goods to be returned. | |
| 6 | Our Right to Cancel | |
| a | We reserve the right to cancel your order if: | |
| i | we have insufficient stock to deliver the Products you have ordered; | |
| ii | we do not deliver to your area; or | |
| iii | one or more of the Products you ordered was listed at an incorrect price due to a typographical error in the pricing information received by us from our suppliers. | |
| b | If we do cancel your order we will notify you by e-mail and will offer an alternative replacement Product or refund to you any amounts paid to us as soon as possible and in any event within 30 days of your order. | |
| c | We shall not be obliged to offer any additional compensation for disappointment suffered. | |
| 7 | Replacement Products | |
| a | Subject to the following provisions of this clause, we warrant that the products will be of satisfactory quality for a period of 12 months from the date of delivery (certain products may have additional benefits provided by the manufacturer). The aforementioned warranty is given by Erange subject to the following conditions: | |
| i | Erange shall be under no liability to the customer for any loss, damage, costs, expenses or other claims: | |
| ii | in respect of any defect arising from any fault of the customer; | |
| iii | in respect of any defect arising from wilful damage, negligence, failure to follow instructions for the use of the Products (whether oral or in writing), misuse or alteration of the Products without our approval; and/or | |
| iv | for Products not manufactured by Erange, in respect of which the customer shall only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to Erange. | |
| b | If you do not receive the Products ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the Products. | |
| c | In the event that you are dissatisfied with your order, the Products delivered to you are damaged or defective incomplete or you have received incorrect Products, we shall have no liability to you unless you notify us in writing (or via email, in which case, you should request an acknowledgment of your email) of the problem within 7 working days of delivery of the Products in question. | |
| d | The customer is solely responsible for satisfying themselves as to the suitability of the Products for any particular purpose and the customer acknowledges that he relies solely on his own skill and judgment and not Erange’s skill and judgment in determining such suitability. | |
| 8 | Liability | |
| a | Nothing in these Terms will limit our liability for death or personal injury resulting from our negligence or that of our employees or agents. | |
| b | In the event that we are unable or fail to deliver the Products ordered within the time period specified, we will use reasonable endeavours to contact you in order to re-schedule the delivery time. Our liability in this respect will be limited to the price of the Products not delivered and the cost of the delivery. | |
| c | We will not be in breach of contract as a result of any delay or failure to perform our obligations as set out in these Terms where such delay or failure to perform arises from circumstances beyond our reasonable control, including (without limitation) any Act of God, communications failure, death, destruction, fire, flood, strikes, riots, accident, disruption to energy supplies, civil commotion, acts of terrorism or war. | |
| d | In any event, the liability of Erange for any breach or the aggregate liability for any series of breaches under or in connection with these Terms shall not exceed the AMOUNT RECOVERED BY Erange FROM ITS PROFESSIONAL INDEMNITY INSURERS IN RESPECT OF THE RELEVANT BREACH OR BREACHES. | |
| e | Erange shall have no liability for loss of profit or for any indirect, special or consequential loss of damage, costs, expenses or other claims for compensation whatsoever arising out of or in connection with the supply or non-supply of the Products (including any delay in supplying the Products) or their use or resale by you. The entire liability of Erange arising out of any order for Products from you will be limited to the total price of the Products ordered by you. | |
| f | You must observe and comply with all applicable regulations and legislation, including all necessary customs, import or other permits to purchase Products from our Website. The importation or exportation of our Products may be prohibited by certain national laws. We make no representation and accept no liability in respect of the import or export of the Products you purchase. | |

| e | Delivery Costs. The cost of delivery of Products purchased via the Website shall be the price advertised on our price list on the Website at the time of purchase together with Value Added Tax and any other relevant tax thereon at prevailing rates from time to time. | |
| f | Payment. Payment for any Product purchased pursuant to these Terms must be made credit or debit card or other method from time to time specified on the Website. | |

| i | Price Validity. The price of Products is fixed at the date of purchase. Future purchases shall be subject to prices prevailing at that time. | |

| a | These Terms govern the contract to the exclusion of all other terms and conditions stipulated in any other communication or document unless expressly agreed in writing by Erange. | |
| b | We may correct any typographical, clerical or other error or omission in any information on the Website or in any email or other document or communication issued by Erange without incurring any liability on our part. | |
| c | If any clause or part of a clause in these Terms is held by any Court of competent authority to be unlawful, invalid or unenforceable, such clause or part shall be severed and the remaining provisions of these Terms shall remain in full force and effect. | |
| d | These Terms, together with our Website prices, delivery details, contact details and privacy policy set out the whole of our agreement relating to the supply of the Products by us. Nothing said by any sales person on our behalf should be understood as a variation of these Terms or as an authorised representation about the nature or quality of any Products offered for sale by us.
